Looking to register as a recognized supplier with the Engineering and Construction Division of the Israeli Ministry of Defense (MOD)? Want to understand the requirements, conditions and your rights? Adv. Ministry of Defense supplier registration

What Is Supplier Registration and Why Does It Matter?

Registration as a recognized supplier with the Engineering and Construction Division is a condition for taking part in tenders and contracts with the Ministry of Defense in construction, infrastructure, maintenance and logistics projects. A registered supplier gains access to many opportunities, but to obtain this status you must meet many regulatory requirements.

Threshold Conditions for Registration

Before starting the registration process, make sure you meet the following requirements (see the division’s supplier regulations):

1. Registration in the Contractors Register

The supplier must be lawfully registered in the Contractors Register, as required by the Law on Registration of Contractors for Engineering Construction Works.

2. Listing as a recognized contractor

The supplier must be listed in the Ministry of Finance’s list of contractors recognized for government works.

3. Professional requirements

The supplier must show previous experience, no criminal or disciplinary convictions, and proven capacity to perform.

4. Essential documents

As part of registration you must submit:

  • A valid business licence
  • Professional certificates (engineer, practical engineer, architect, etc.)
  • Insurance, safety and environmental approvals as required

Taking Part in MOD Tenders: What Is Allowed and What Is Not

  • Only registered suppliers may submit bids.
  • The supplier must submit an independent bid, not through a third party.
  • Submitting a bid is a full commitment to all tender terms.
  • Withdrawing a bid may lead to exclusion and a negative record in the supplier database.

The Order Stage: What Is Required After Winning?

  • Confirming the order: the order must be confirmed within one business day.
  • No work without an order: no work may be performed and no equipment purchased before a signed order is received.

Required Licences and Approvals

The Ministry of Defense requires suppliers to hold:

  • A valid business licence
  • A contractor’s licence (with the appropriate classification for the field)
  • Safety approvals, relevant ISO standards and more

Duty to Report a Criminal Investigation: A Critical Clause

When signing the division’s supplier regulations, the supplier must declare that, to the best of its knowledge, no criminal investigation is being conducted against it or any of its shareholders, and that no indictment has been filed against any of them. If a criminal investigation is under way at the time of signing, the supplier must set out, in a properly sworn affidavit, the suspicions against it and the status of the investigation. If an indictment has been filed, it must be attached, with the stage of the proceedings.

In addition, the supplier has a continuing duty to report: it must notify the division in writing of any criminal investigation opened or indictment filed against it throughout the period of its registration. Each such case is referred to the competent officials in the division, together with the Legal Adviser to the Defense Establishment and the Directorate of Security of the Defense Establishment (MALMAB), to protect the ministry’s security and regulatory interests.

Breach of this duty is a fundamental breach of contract

Failure to meet these reporting requirements is considered a fundamental breach of the contract between the supplier and the Ministry of Defense, which may lead to cancellation of registration, suspension from tenders and even legal claims.

Supplier Evaluation

The division continuously evaluates all registered suppliers. The criteria include:

  • Meeting deadlines
  • Quality of work
  • Staying within budget
  • Satisfaction of the military clients

Low scores may lead to suspension and even removal from the supplier database.

Sensitive Information and Confidentiality

  • All information the supplier receives in the course of its engagement with the Ministry of Defense is considered classified and sensitive.
  • Passing information to third parties is strictly prohibited.
  • Every supplier must sign a confidentiality undertaking, including its employees, subcontractors and officers.

Transferring Classified Engagements: Only with Approval

A contract or activity related to classified work may not be transferred without express written approval from the Engineering and Construction Division. Doing so is considered a breach of contract.

Validity of Recognition

Recognition as a supplier is valid for 5 years, but requires continuous maintenance of documentation, compliance with standards and regular reporting.

  • At the end of the period, registration must be renewed.
  • A supplier that does not meet the criteria will not have its registration renewed.
